1. Agreement
MashON is operated by Leff IT LLC (“MashON,” “we,” “us,” or “our”). By downloading, accessing, or using MashON, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use MashON. These terms supplement any terms that apply through Apple’s App Store, including Apple’s standard licensed application end-user terms where applicable.
2. Eligibility
You must be at least 13 years old and meet any higher minimum age required in your location to create a MashON account. If you are a minor, use MashON only with a parent’s or guardian’s permission where required by law. If you use MashON for an organization or team, you represent that you have authority to accept these terms for it.
3. Cycling, health, and road safety
MashON is not an emergency, medical, navigation, traffic-safety, or collision-avoidance service. Live positions may be delayed, inaccurate, incomplete, or unavailable. Never rely on MashON to avoid vehicles, riders, hazards, or getting lost.
- Stay alert, obey traffic laws, and ride within your ability.
- Mount or store devices safely and do not interact with screens while moving when it would be unsafe or illegal.
- Check routes, weather, equipment, fitness, and local conditions before riding.
- Stop and seek professional help for a medical concern. Contact local emergency services in an emergency.
- Do not let rankings, challenges, ghost pacing, or group metrics encourage unsafe speed or conduct.
Health, power, heart-rate, speed, cadence, distance, route, and weather information may be estimated or supplied by devices and third parties. It is informational and not medical advice.
4. Your account and invitations
You are responsible for accurate account information, control of your device and credentials, and all activity under your account. Notify us promptly if you suspect unauthorized access.
Mash codes and challenge links can provide access to private activities or routes. Share them only with intended recipients. We may limit, revoke, or invalidate invitations to protect riders and the service.
5. Your routes, photos, and other content
You retain ownership of content you submit, including profile photos, route files, ride names, and challenge details. You grant MashON a worldwide, nonexclusive, royalty-free license to host, process, reproduce, transmit, adapt, and display that content only as reasonably needed to operate, secure, improve, and support the service and the features you choose.
You represent that you have the rights needed to submit the content and that it does not violate law, privacy, intellectual-property rights, or another person’s safety. Routes can reveal sensitive home, work, or travel locations; review and trim them before sharing.
6. Acceptable use
You may not:
- harass, stalk, threaten, impersonate, or endanger another person;
- share another person’s location, health information, route, or identity without authorization;
- use MashON for unlawful races, trespass, unsafe conduct, surveillance, or emergency dispatch;
- probe, bypass, disrupt, reverse engineer, scrape, overload, or gain unauthorized access to the service, except where law expressly permits;
- upload malicious code or content that infringes rights; or
- sell, transfer, or commercially exploit access to MashON without written permission.
7. Apple, Strava, weather, maps, and other services
MashON may interoperate with Apple Health, Apple Watch, WeatherKit, Strava, mapping, sensor, and cloud services. Your use of those services is also governed by their terms and privacy policies. We are not responsible for third-party availability, data accuracy, policy changes, or actions. You choose whether to grant or revoke optional permissions and connections.
8. MashON ownership
MashON’s software, visual design, branding, logo, text, and service technology are owned by Leff IT LLC or its licensors and are protected by applicable laws. These terms provide a limited, personal, revocable, nontransferable license to use the app and website for their intended purpose; they do not transfer ownership.
9. MashON Pro subscriptions
When offered for purchase in the app, MashON Pro is an auto-renewable subscription available through Apple’s in-app purchase system. The U.S. prices are $4.99 per month or $39.99 per year, plus any applicable taxes. Prices in other App Store countries or regions may differ. The price and billing period shown by Apple when you confirm your purchase are the terms of that transaction.
MashON Pro offers eligible new subscribers one seven-day free trial with either the monthly or annual plan. Apple determines eligibility and displays the offer before purchase. Unless you cancel before the trial ends, the subscription automatically converts to the plan you selected and Apple charges the price displayed when you started the trial.
MashON Pro includes weather information during activities, the ability to create public challenges with reusable links and leaderboards, the ability to create and manage a persistent Mash Team, and group Mashes for up to 10 riders instead of the free plan’s limit of 3 riders. Joining an invited Mash Team does not require Pro. These benefits are available only on supported devices, in supported locations, and while your Pro entitlement is active.
Your subscription automatically renews for the same period unless you cancel it before the renewal date. Apple charges the payment method associated with your Apple Account. You can manage or cancel the subscription in your Apple Account subscription settings. Cancellation stops future renewal, but Pro access ordinarily continues through the end of the period you already paid for unless Apple issues a refund or revokes the transaction.
Deleting your MashON account or removing the app does not cancel an Apple subscription. Cancel the subscription separately through Apple before deleting your account if you do not want it to renew. Account deletion may prevent you from using subscription benefits and does not by itself create a right to a refund.
Apple handles subscription billing and determines refund eligibility, subject to applicable law. Use MashON’s Restore Purchases option with the Apple Account that made the purchase to restore an eligible subscription on a supported device. Family Sharing is not supported.
If Apple reports that your subscription expired, failed to renew, was refunded, or otherwise no longer provides an active entitlement, Pro access ends. Apple Billing Grace Period is not currently enabled. If a Mash Team owner loses Pro access, MashON may keep that team active for up to seven days before pausing owner-only team features; this MashON continuity window is separate from Apple Billing Grace Period, does not extend the paid subscription, and does not defer Apple charges.
We will provide the advertised Pro benefits throughout a paid subscription period as required by applicable law and Apple’s terms. Apple may provide notice or request consent before a price increase. Any changed price applies only as communicated through Apple and these terms do not limit rights you have under consumer-protection law.
10. Availability, changes, and termination
Features may be experimental, delayed, interrupted, modified, or discontinued. Changes to MashON Pro are subject to the paid-period commitments above. We may suspend or terminate access when reasonably necessary for security, legal compliance, misuse, an inactive subscription entitlement, or protection of riders. You may stop using MashON at any time and may delete your account in the app, but account deletion does not cancel an Apple subscription.
11. Disclaimers
To the maximum extent permitted by law, MashON is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, safety, and uninterrupted availability. We do not warrant that routes, metrics, locations, rankings, weather, sensors, or third-party data will be accurate or suitable for any ride.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, MashON and its operators, affiliates, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of profits, personal-device damage, or claims arising from reliance on live position, route, fitness, weather, or performance information.
Nothing in these terms excludes liability that cannot legally be excluded, including rights you may have under consumer-protection law.
13. Disputes and general terms
Before filing a formal claim, contact us and give us a reasonable opportunity to resolve the issue informally. Applicable law and courts will be determined by mandatory consumer law and other conflict-of-law rules that apply to you and the MashON operator.
If any provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a term is not a waiver. We may update these terms by posting a revised effective date and, for material changes, providing additional notice when appropriate. Continued use after the change takes effect means acceptance where permitted by law.
